South Africa has been classified by the World Bank as a newly industrialised country, with the second-largest economy in Africa. South Africa’s labor market is heavily regulated by the Basic Conditions of Employment Act (BCEA) and the Labour Relations Act (LRA). In 2026, the landscape has been significantly reshaped by a landmark Constitutional Court ruling that replaced traditional gender-specific leave with a unified parental framework. Effective March 1, 2026, the National Minimum Wage is R30.23 per ordinary hour, applying equally to general, farm, and domestic workers. All employees must now have a valid SARS Income Tax Reference Number for payroll filing.

Employees are entitled to 21 consecutive days of paid annual leave (typically 15 working days) per 12-month cycle. South Africa observes 12 public holidays. If a public holiday falls on a Sunday, the following Monday is a paid holiday.

Historically, birth mothers were entitled to 4 consecutive months of unpaid maternity leave, protected by law. However, under the 2026 Unified Parental Leave framework, this has been expanded:
Entitlement: The birthing parent (mother) remains entitled to at least 4 consecutive months of leave.
Payment: While the employer is not legally required to pay, employees can claim UIF Maternity Benefits (ranging from ~38% to 60% of salary, subject to a cap).
Protections: It is illegal to dismiss a woman for pregnancy, and she is entitled to return to the same or a similar role.

Following the 2026 legal reforms, traditional “Paternity Leave” has been merged into a Shared Parental Leave system:
Shared Entitlement: All parents (including fathers and adoptive parents) are now entitled to a shared allocation of four months and ten consecutive days of parental leave if both parents are employed.
Flexibility: Parents can choose how to split this 4-month-plus pool, though the non-birthing parent is guaranteed at least 10 consecutive days if the other parent takes the primary 4-month block.

Sick Leave: During a 36-month cycle, an employee is entitled to paid sick leave equal to the number of days they would work in a 6-week period (e.g., 30 days for a 5-day week). In the first 6 months, it is 1 day for every 26 days worked.
Family Responsibility Leave: Employees with >4 months of service are entitled to 3 days of paid leave per year for the death of a close relative or the sickness of a child.

Termination Process

Dismissal must be both substantively fair (valid reason) and procedurally fair (proper hearing). “At-will” termination is not recognized. For Operational Requirements (Retrenchment), the statutory minimum severance pay is one week’s remuneration for every completed year of continuous service.

Notice Period

Notice periods are generally based on length of service:
First 6 months: 1 week notice.
6 months to 1 year: 2 weeks notice.
More than 1 year: 4 weeks notice (1 month).

Probation Period

The standard probation period is 3 to 6 months. Under new 2026 amendments, protection against unfair dismissal for “performance” is slightly more flexible during the first 3 months of probation, though “automatically unfair” dismissals (e.g., for pregnancy or union activity) remain strictly prohibited from day one.
